Dutch government cannot evict Somali refugees

Rejected Somali asylum seekers in the Netherlands cannot at this point in time be evicted from the country, says the Dutch Council of State.
This decision is the outcome of an appeal that Dutch minister of immigration and asylum Gerd Leers had filed against an earlier decision this past April, whereby a Dutch court ruled that Somali asylum seekers cannot be held in temporary detention.
The council agreed with the court because no plans for eviction within a reasonable period of time are foreseen. The council believes that it is not feasible for the refugees to safely travel via Somalia’s capital city of Mogadishu to reach South and Central Somalia.
The judge noted that, according to Minister Leers, a foreigner in Mogadishu "merely through his presence" risks becoming a victim of "indiscriminate violence" because of the armed conflict in the city. According to the council, this applies not only for people who want to settle there, but also for those in transit.

There is no option to appeal to this decision.
